WAIVER AND RELEASE OF LIABILITY

I UNDERSTAND AND ACCEPT THAT SKIING, SNOWBOARDING, AND OTHER SNOW SPORTS ARE INHERENTLY DANGEROUS AND INVOLVE SIGNIFICANT RISKS OF SERIOUS INJURY OR DEATH. Such risks include, but are not limited to, changing weather and snow conditions, avalanches, tree wells, rocks, variable terrain, collisions with other people, equipment, or natural and man-made objects, equipment failure or misuse, and risks associated with chairlifts and surface lifts. In consideration of being allowed to use the facilities, lifts, and premises of WGSKI, LLC dba SKI BLUEWOOD (“Ski Bluewood”), I AGREE TO ASSUME ALL RISKS of injury, death, or property damage arising out of or related to my participation. I HEREBY RELEASE, HOLD HARMLESS, DEFEND, AND INDEMNIFY Ski Bluewood, its owners, officers, managers, employees, agents, instructors, and volunteers FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION RESULTING FROM MY PARTICIPATION, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF SKI BLUEWOOD OR ITS EMPLOYEES, to the fullest extent permitted by law. 

I understand that in the event of an accident, emergency medical services, including ambulance or air ambulance (Life Flight), may be required, and I ACCEPT FULL FINANCIAL RESPONSIBILITY for all associated costs. I further understand that COLLISIONS BETWEEN SKIERS, SNOWBOARDERS, OR OTHER PARTICIPANTS ARE CONSIDERED A PERSON-TO-PERSON MATTER and Ski Bluewood has no liability for such incidents, regardless of fault. I agree to follow all posted signs, rules, and regulations, and to comply with the WASHINGTON SKIER SAFETY ACT (RCW 79A.45) and the Columbia County Skier Safety Ordinance 90-4. If I am signing on behalf of a minor, I accept full responsibility for the minor’s participation, all related medical expenses, and agree to indemnify Ski Bluewood from any claims brought by or on behalf of the minor. I further agree that ANY DISPUTES arising out of this Agreement, my season pass, or my use of Ski Bluewood facilities SHALL BE GOVERNED BY WASHINGTON LAW AND BROUGHT EXCLUSIVELY IN THE SUPERIOR COURT OF COLUMBIA COUNTY, WASHINGTON. I also grant Ski Bluewood permission to use my image or likeness in photos or videos for marketing purposes. BY USING A LIFT TICKET OR SEASON PASS, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO ALL TERMS OF THIS WAIVER AND RELEASE.
